This article applies to organisations that provide assisted reproductive technology (ART) services in Queensland.
Assisted Reproductive Technology Regulation 2026 (Qld)
On 13 February 2026, the Assisted Reproductive Technology Regulation 2026 (Qld) (the Regulation) passed Queensland Parliament and commenced on 1 March 2026.
The Regulation is made under the Assisted Reproductive Technology Act 2024 (Qld) (the Act) and will commence alongside related provisions under the Act.
Operationally Significant Changes
The most significant change (from an operational perspective) is the establishment of the Regulation to support the framework of the Act, by prescribing additional requirements for ART providers in relation to consent, counselling, and licensing.
Further Information
Most notably, the Regulation makes provision for:
- additional information that ART providers are required to provide before ART services are undertaken (e.g. the risks, benefits and limitations in relation the person’s circumstances; the cost);
- matters about which counselling is to be provided to people involved in donor conception (e.g. discussion of the social and psychological implications of being a donor; the effect of their consent and how they may modify or withdraw their consent);
- further consent requirements in relation to donors and people undergoing an ART procedure (e.g. an acknowledgment that the ART provider has informed them about how and when their consent may be modified or withdrawn; separate consents for each cycle of treatment if applicable);
- additional steps an ART provider must take when inquiring whether a gamete provider is still alive if the gamete was obtained more than five years before the ART procedure (e.g. attempting to contact the gamete provider; inquiring into other States or overseas registrations); and
- additional events that a licensed provider must give notice to the chief executive of (e.g. acting without consent or departure from consent; laboratory practices that are substandard or result in harm; disruption of business operations).
